Course Description:
This course is designed to provide professional engineers
with an overview of the federal laws pertaining to collections practices,
examine the business practices and procedures that should be in place prior to
extending credit, and to illustrate the obstacles to collecting debt and strategies
to overcome them.

Course Outline:
Section 1- Playing by
the Rules- Establishes
the importance of knowing the rules that govern debt collection practices for
all professionals in a position to extend credit to clients; Shows how lawmakers have attempted to strike
a balance between the protection of debtors and the repayment to creditors;
Introduces the Fair Debt Collections Practices Act, who it is applicable to and
how it is perceived by debtors; The legal means by which to collect and the
prohibited collections activities are both outlined in detail, and a few
examples of state debt collections laws are also given; The various types of
bankruptcy are discussed including how the filed petition impacts debt
collection activities for the creditor; and property that is exempt from levy,
or out of bounds to creditors is also addressed with state examples.

Section 2- Winning
Before the Coin Toss-
Reviews the importance of clear and concise written agreements; Establishes the
importance of knowing the lien laws in local jurisdictions having authority and
the crucial role timing plays in enforcing a lien; Pinpoints the type of protection a claim of
lien can offer as well as the types of moves an owner or client may have
available to them in contesting a lien; Reinforces the importance of
recordkeeping and credit management, including how to make decisions about
granting credit; Provides insight as to understanding debtors from a
psychological perspective even before you have made a deal with them; and
Outlines the various types of debtor personalities and their tactics for
avoiding payment.
Learning Exercise 2
Section 3- Game Time- Quickly reviews the debtor
personalities pinpointed in the previous section and their various tactics in
avoiding payment; Provides insight in helping you determine what type of debtor
you’re dealing with and the most appropriate course of action to persuade them
to pay; Discusses how to set up a payment plan and when you should compromise
with a debtor; Reviews the pros and cons of litigation as well as a few
vocabulary words you should be familiar with in settlement negotiations;
Pinpoints actions that need to be taken after a judgment is entered in your
favor including finding assets, interviewing the debtor, and filing paperwork;
Discusses the benefits and appropriate situations for settling in small claims
court and the typical procedures for doing so and; Presents a scenario where
the most intelligent course of action is to simply cut your losses and move on,
while still keeping a small stake in the game.

Method of
Presentation: This is an online course that
consists of collegiate-style lectures that have been professionally narrated by
subject matter experts, animated with relevant graphics and media, and
converted to Flash for web delivery to provide
licensees with a first-rate learning experience.
Evaluation Method:
Licensees will be evaluated on their comprehension of the
material covered by administering Three (3) brief learning exercises,
interspersed throughout the course, upon which successful completion of
each is required before advancement to
the next section is allowed or course credit is earned. If the licensing board requires the licensee
to pass a final examination, course credit will not be earned until the final
exam has been completed to the required proficiency level.

Instructor Bio:
Charles has practiced law in Pinellas County Florida for over
30 years, specializing in general practice and construction litigation. He has degrees from the
